The American Booksellers Association joined a Reporters Committee’s amicus brief in the NetChoice vs Attorney General, State of Florida case before the 11th Circuit. The amicus argues against a Florida law (S.B.7072) that would give the government wide latitude to interfere with a website owner’s (including a bookstore's) right to curate, moderate, or limit the content that can be posted on their website. The law, if upheld, gives the government wide latitude to interfere with a website owner’s rights to moderate or limit the content that can be posted on their site. It could mean years of litigation about what sites and site functions are protected by the First Amendment and which ones are not. This would have a substantial chilling effect on any website that is worried about being sued by a user.
