8th Circuit Issues Decision in Penguin Random House v. Robbins
On Monday, the 8th Circuit Court of Appeals issued a disquieting ruling in Penguin Random House v. Robbins, which will allow Iowa’s school book ban and “Don’t Say Gay” law to go back into effect.
Overturning the lower court’s preliminary injunction, a three-judge panel ruled that school library curation should be treated as curriculum and “school-sponsored speech” less subject to First Amendment challenge. This decision joins the 5th Circuit’s Little v. Llano County decision in allowing some states greater authority to dictate curation decisions to local communities and the experts they choose to make their library decisions.
ABA stands with the students, parents, authors, publishers, librarians, and educators whose right to transmit and receive information will be limited by this decision, and of course with booksellers in impacted communities.
